Terms of Service
A Covenant of Ownership, Integrity, and Provenance.
Welcome to Neil Louw’s online studio. This document constitutes a full operational and legal agreement governing the access, acquisition, confidentiality, and stewardship of collectible assets. By engaging with our platform, you acknowledge and agree to the following terms:
Access & Eligibility
Our platform is designed for discerning collectors. To maintain the integrity of our collector ecosystem, we reserve the right to approve, decline, or restrict access at our sole discretion.
Acquisition, Pricing & Valuation
Acquisition Process: Purchases are confirmed only upon full payment clearance. Artworks are allocated on a first-come, professionally verified basis. We may request additional identity, provenance, or transactional information before releasing high-value pieces.
Pricing: Prices reflect artist market value, rarity, and conservation standards. They are subject to change without prior notice. Historical prices do not constitute a precedent for future valuations.
Packaging & White-Glove Logistics
Our shipping protocols are engineered to protect the integrity and long-term value of every artwork:
Packaging Standards: Each artwork is preserved in archival, acid-free materials and secured within custom-crafted crates designed for vibration resistance and climate stability.
Shipping Partners: We exclusively partner with vetted art-handling specialists who recognize these works as investment assets rather than standard parcels.
Insurance: All shipments are fully insured for their declared value from the moment of departure until confirmed delivery. Insurance documentation is shared with the collector prior to dispatch.
Global Delivery & Confirmation
International Shipping: Available to approved destinations. High-risk regions may require additional clearance, security protocols, or handling fees.
Signature Requirement: Due to the sensitivity of these assets, all deliveries require an in-person signature by the verified recipient or an authorized representative.
Unboxing & Discrepancies
Unboxing Protocol: We strongly advise collectors to video record the unboxing process in real time. This documentation is vital for insurance claims, provenance continuity, and future valuation.
Reporting Window: Any damage, tampering, or irregularity must be reported within 48 hours of receipt, supported by video evidence. Claims made outside this window may affect eligibility for remedy procedures.
Data Protection & Platform Integrity
Confidentiality: Collector information is handled with absolute confidentiality. We do not sell, rent, or distribute personal or transactional data. All sensitive information is secured through encrypted protocols.
Intellectual Property: Unauthorized scraping, duplication, or digital reproduction of platform content, imagery, or artwork files is strictly prohibited and will be prosecuted to the fullest extent of the law.
Amendments
We retain the right to update these terms to reflect market, legal, or operational shifts. Continued use of the platform constitutes acceptance of the most current terms.
Collector Acquisition Agreement
A Formal Pact for High-Value Asset Exchange.
This agreement governs transactions between the collector and Neil Louw’s studio when acquiring original artworks, limited editions, or rare collectible assets:
Verification of Authenticity:
Each piece is guaranteed authentic, vetted through the artist, their estate, or an accredited third-party body. No artwork leaves our custody without formal certification.
Ownership Transfer:
Upon successful payment and dispatch, full physical ownership transfers to the collector. Intellectual property rights remain with the artist unless otherwise specified in writing.
Edition Integrity:
All limited editions are strictly capped. We do not reprint or reproduce editions that have sold out. Any special releases or reworks are issued under distinct classifications to protect value.
Resale Conditions:
Some works may include resale guidelines, right-of-first-refusal clauses, or resale royalties in accordance with market standards. These conditions are binding on subsequent owners.
Confidentiality:
High-value acquisitions remain private unless the collector requests or consents to public acknowledgment or registry display. Discretion is our default operating principle.
Dispute Resolution:
In the rare event of a dispute regarding valuation, condition, or provenance, matters will be resolved through accredited art arbitrators or industry-recognized valuation boards.
